Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Traveler," "you," or "your") and Take Up Space Studios LLC ("Company," "we," "us," or "our"). These Terms govern your use of our website, booking platform, events, group trips, and all related services (collectively, "Services").

By accessing our website, creating an account, booking a trip, submitting a deposit or payment, or participating in any trip or event, you acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree, you must not use our Services or participate in any trip.

These Terms also incorporate our Privacy Policy, which is binding upon you. If you are booking on behalf of another person, you represent that you have full authority to bind that person to these Terms and that they have been informed of and agree to these Terms.

2. Eligibility

You must be at least 18 years of age to book or participate in any trip. By booking, you represent and warrant that you are 18 or older and legally capable of entering into a binding contract. Travelers under 18 may only participate if accompanied by a parent or legal guardian who has accepted these Terms on their behalf.

You further represent that you are not prohibited by any applicable law from purchasing travel services and that all information you provide to us is accurate, current, and complete.

3. Trip Bookings and Traveler Information

When you book a trip, you agree to provide complete and accurate traveler information, including full legal name (as it appears on your passport), passport number and expiration date, date of birth, nationality, contact phone number, emergency contact name and number, dietary restrictions, and any relevant medical conditions, disabilities, or allergies. You are solely responsible for keeping all such information current in your account.

You are responsible for ensuring that your travel documents — including passport, visa, and any required health documentation — are valid, current, and meet the entry requirements of all destination countries. Take Up Space Studios bears no responsibility for denied boarding, denied entry, deportation, or other consequences arising from inadequate or expired travel documents.

Providing false or incomplete information may result in removal from a trip without refund and may constitute a breach of these Terms.

4. Payments, Refunds, and Cancellations

Trip-specific pricing, deposit amounts, payment schedules, and cancellation deadlines will be communicated at the time of booking and are incorporated into these Terms by reference. All payments are processed in U.S. dollars unless otherwise stated.

Deposits are generally non-refundable and secure your spot on a trip. Balance payments are due by the date specified at booking. Failure to complete payment by the due date may result in cancellation of your reservation without refund of any amounts paid.

If you cancel your booking, you may be entitled to a partial refund depending on how far in advance of the trip departure you cancel, as specified in the trip-specific cancellation policy provided at booking. Refunds, where applicable, will be issued to the original payment method and may take 5–10 business days to process. Payment processing fees are non-refundable.

Take Up Space Studios reserves the right to cancel or modify a trip due to insufficient enrollment, safety concerns, force majeure events, or circumstances outside our control. In the event we cancel a trip, we will make reasonable efforts to offer a credit or partial refund, but we are not liable for any incidental or consequential costs you incur, including but not limited to flights, accommodations booked independently, visa fees, or travel insurance premiums.

5. Travel Insurance — Mandatory Requirement

Obtaining and maintaining adequate travel insurance is a mandatory condition of participation in any Take Up Space Studios trip. Each traveler is individually and solely responsible for securing their own coverage prior to departure. Take Up Space Studios does not provide, arrange, recommend, or facilitate travel insurance, health insurance, medical insurance, trip cancellation insurance, evacuation coverage, or any other insurance or coverage on your behalf, and we are not licensed to do so.

Your travel insurance policy should, at a minimum, provide coverage for:

  • Emergency medical treatment, hospitalization, and surgery;
  • Emergency medical evacuation and repatriation to your home country;
  • Trip cancellation, interruption, and delay;
  • Lost, stolen, or damaged baggage and personal belongings;
  • Accidental death and dismemberment;
  • Adventure or activity-specific coverage if your trip includes physical, outdoor, or adventure activities (e.g., hiking, watersports, or similar).

By completing a booking, you represent and warrant that you have obtained, or will obtain before the trip departure date, a travel insurance policy that meets or exceeds the above minimums. You agree to provide proof of insurance to Take Up Space Studios upon request.

Take Up Space Studios bears absolutely no financial, legal, or other responsibility for any costs, losses, damages, or claims that arise from your failure to obtain adequate travel insurance, including but not limited to medical bills, evacuation costs, or non-refundable trip expenses.

6. Assumption of Risk

YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS — KNOWN AND UNKNOWN — ASSOCIATED WITH TRAVEL AND PARTICIPATION IN ANY TAKE UP SPACE STUDIOS TRIP OR EVENT.

Travel inherently involves risks that cannot be eliminated. These risks include, without limitation:

  • Physical injury, illness, disability, or death arising from any activity, transportation, accommodation, or circumstance during the trip;
  • Property damage, loss, or theft of personal belongings, luggage, electronics, or valuables;
  • Flight cancellations, delays, missed connections, or rerouting by airlines or other carriers;
  • Natural disasters, severe weather, earthquakes, floods, hurricanes, or other acts of God;
  • Civil unrest, political instability, riots, strikes, government actions, or acts of terrorism or war;
  • Disease outbreaks, pandemics, epidemics, or public health emergencies;
  • Food- or water-borne illness, allergic reactions, or exposure to local environmental conditions;
  • Negligence, misconduct, or errors of third-party vendors including airlines, hotels, restaurants, tour operators, local guides, transportation providers, and activity operators;
  • Inadequate or unavailable medical care or emergency services at the destination;
  • Currency fluctuations, fraud, theft, or other financial risks abroad.

You acknowledge that Take Up Space Studios does not control third-party vendors, local conditions, foreign governments, or events of nature. You accept full, personal responsibility for your own safety, health, and well-being at all times before, during, and after any trip, including during free time and optional activities.

7. Injuries, Illness, and Medical Incidents

Take Up Space Studios is not responsible — financially, legally, or otherwise — for any injury, illness, medical condition, disability, or death that occurs during or in connection with any trip or event, regardless of cause, including any negligence on the part of Take Up Space Studios or its staff.

This applies to incidents that occur at any time during the trip, including during organized group activities, downtime, free exploration, transit between destinations, at accommodations, at restaurants or venues, during optional excursions, and before or after the scheduled trip itinerary while traveling with the group.

All costs associated with medical treatment, hospitalization, surgery, prescription medications, emergency evacuation, medical repatriation, long-term care, or any other health-related expenses arising during or after a trip are the sole financial responsibility of the individual traveler. Take Up Space Studios will not advance, reimburse, indemnify, guarantee, or otherwise cover any such costs under any circumstances, regardless of fault.

You represent that you are in sufficient physical and mental health to participate in the trip you have booked. You agree to disclose to us in writing, prior to departure, any medical condition, disability, pregnancy, allergy, or health circumstance that may affect your participation or require accommodation. Failure to disclose known health conditions that result in a medical incident does not create any liability for Take Up Space Studios.

Take Up Space Studios staff or trip leaders may, at their sole discretion and as a courtesy, assist in contacting emergency services or coordinating emergency logistics. Any such assistance is provided in good faith only and does not create any duty of care, legal obligation, or liability on the part of Take Up Space Studios or its personnel, and does not constitute an assumption of responsibility for outcomes.

8. Release of Liability, Waiver, and Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY IRREVOCABLY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE TAKE UP SPACE STUDIOS LLC AND ITS MEMBERS, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, INDEPENDENT CONTRACTORS, TRIP LEADERS, AGENTS, GUIDES, AND AFFILIATES (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, LIABILITIES, DEMANDS, ACTIONS, CAUSES OF ACTION, COSTS, EXPENSES, AND DAMAGES OF ANY KIND OR NATURE — WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN — ARISING OUT OF OR IN ANY WAY RELATED TO YOUR PARTICIPATION IN ANY TRIP OR EVENT.

This release and waiver includes, without limitation, claims arising from or related to: personal injury; bodily harm; illness; death; emotional distress; psychological harm; property damage or destruction; theft or loss of personal belongings; financial loss; travel disruption; the acts, omissions, or negligence of the Released Parties or any third party; force majeure events; or any other cause whatsoever.

In no event shall the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind. To the extent any liability is found notwithstanding this release, the total aggregate liability of Take Up Space Studios to you shall not exceed the total amount you actually paid directly to Take Up Space Studios for the specific trip giving rise to the claim. This cap applies regardless of the theory of liability, including contract, tort, strict liability, or otherwise.

Indemnification: You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; (c) your conduct during a trip or event; (d) any claim by a third party resulting from your actions or omissions; or (e) any misrepresentation you make to us.

Some jurisdictions do not permit the exclusion of certain warranties or limitation of certain liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes liability for fraud or for death or personal injury caused by gross negligence where such exclusion is prohibited by law.

9. Third-Party Vendors and Services

Take Up Space Studios acts as a trip organizer and may engage third-party vendors — including airlines, hotels, ground transportation providers, activity operators, restaurants, and local guides — to provide services during trips. These vendors operate independently and are not employees, agents, or representatives of Take Up Space Studios.

Take Up Space Studios is not responsible or liable for the acts, omissions, errors, negligence, bankruptcy, or insolvency of any third-party vendor. By booking a trip, you acknowledge that you may be subject to the separate terms, conditions, and policies of third-party providers, and you agree to comply with them. Any dispute with a third-party vendor is solely between you and that vendor.

10. Traveler Conduct and Removal from Trip

You agree to conduct yourself in a respectful and lawful manner at all times during a trip. You will not engage in behavior that is disruptive, threatening, abusive, discriminatory, or that endangers the safety or enjoyment of other travelers, trip leaders, or third parties.

Take Up Space Studios reserves the right, at its sole discretion, to remove you from a trip at any time if your conduct is deemed harmful, disruptive, illegal, or incompatible with the group experience. In such cases, you will be responsible for all costs associated with your departure and return travel, and no refund will be issued for unused trip portions.

You agree to comply with all applicable local laws and regulations at every destination. Take Up Space Studios is not responsible for any legal consequences you face as a result of your conduct abroad.

11. Photo, Video, and Media Release

By participating in a trip or event, you grant Take Up Space Studios a perpetual, worldwide, royalty-free, irrevocable license to use photographs, videos, testimonials, and other media featuring your likeness, voice, or appearance captured during the trip for marketing, promotional, editorial, and commercial purposes across all media channels, including social media, website, print, and advertising, without further consent or compensation to you.

If you do not wish to be included in trip media, you must notify us in writing before the trip departs. We will make reasonable efforts to accommodate such requests but cannot guarantee exclusion from all incidental photography or video.

12. Health, Fitness, and Special Needs

You represent that you are in good physical and mental health and are capable of participating in the trip activities described at booking. You acknowledge that it is your responsibility to consult with a qualified physician before traveling, particularly if you have any pre-existing medical condition, physical limitation, or are taking prescription medications.

Take Up Space Studios may, in its sole discretion, deny participation or require you to withdraw from a trip if, in our reasonable judgment, your health condition poses a risk to yourself or other travelers. In such cases, refund eligibility will be governed by the applicable cancellation policy.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or your participation in a trip shall be resolved by binding arbitration administered by a mutually agreed-upon arbitrator, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity. Any arbitration or legal proceeding must be initiated within one (1) year of the date the claim arose; claims brought after this period are permanently barred.

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Changes to These Terms and Contact

Take Up Space Studios reserves the right to update or modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our Services or participation in any trip after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
